⚖️ Mabel Boutique Terms of Service and General Conditions

This document outlines the governing terms and conditions for all transactions and engagements between the consumer and Mabel Boutique .

Contract:
A distance contract established between the consumer and Mabel Boutique  (the Entrepreneur).

Consumer:

Withdrawal Period:
The fixed duration during which the consumer may exercise their Right of Withdrawal (14 calendar days).

Durable Medium:
Any tool that allows information (personally addressed) to be stored for future, unaltered retrieval.

Distance Communication:
Any method used to conclude a contract without the consumer and entrepreneur being physically present at the same time.

General Terms:
These General Terms and Conditions governing the operations of Mabel Boutique .

Article 3 – Scope of Application

These General Terms apply to every offer made by Mabel Boutique  and to every concluded distance contract or order.

Prior to contract conclusion, these terms will be made available. If not feasible, the consumer will be informed where the terms can be reviewed electronically or obtained free of charge.

Should these terms conflict with specific product or service conditions, the most favorable provision for the consumer will always prevail.

If any part of these terms is deemed invalid, the remaining provisions will remain fully enforceable. The invalid term will be replaced by a mutually agreed provision that best matches the original intent.


Section III: Offers and Agreement

Article 4 – The Offer Details

Limited-time offers or special conditions will be clearly defined. Our offers are non-binding, and we reserve the right to modify or adjust them.

The offer includes a clear and truthful description of the products. Any images used are meant to be an accurate representation, but minor color discrepancies may occur due to photography or screen settings.

All offers explicitly state:

  • The price (excluding import duties and VAT)

  • Applicable shipping costs

  • How the contract is concluded

  • Information on the Right of Withdrawal

  • Payment, delivery, and execution methods

  • The acceptance period for the offer


Article 5 – Establishing the Contract

The purchase contract is confirmed once the consumer accepts the offer and fulfills the corresponding conditions. If acceptance is confirmed electronically by Mabel Boutique , the consumer may dissolve the contract until that confirmation is received.


Section IV: Pricing, Payment, and Fulfillment

Article 9 – Pricing Integrity

Product prices stated in the offer will remain unchanged during the validity period, unless legally required price adjustments (such as tax changes) must be made.


Article 12 – Payment Requirements

Unless otherwise specified, full payment is required at the time of purchase. All transactions are subject to our Terms of Service, which govern pricing, payment, and delivery. We retain the right to correct any inaccuracies in pricing, description, or availability without prior notice.


Article 11 – Delivery and Execution

We execute all orders with the greatest possible care.

If any delay in delivery occurs, the consumer will be informed as soon as possible.


Article 10 – Product Compliance and Warranty

Mabel Boutique  guarantees that all delivered products and services comply with the terms of the contract and meet reasonable standards of functionality, quality, and reliability.


Section V: Returns, Exchanges, and Legal Recourse

Article 6 – Right of Withdrawal (Cooling-Off Period)

The consumer may return non-sale products within 14 days of receipt without needing to state a reason. The item must be returned in its original condition and packaging.

Items purchased during Final Sales (40% discount or higher) are non-returnable. This exclusion is always explicitly stated in the sale offer.


Article 7 – Withdrawal Costs and Refund

If the consumer exercises the Right of Withdrawal, they must cover the cost of return shipping.

Mabel Boutique  will refund all received payments, including the original shipping costs, within 14 days after we have received the returned product or proof of shipment.


Article 8 – Items Excluded from Withdrawal

The Right of Withdrawal does not apply to:

  • Items that cannot be returned due to hygiene or health protection reasons (e.g. certain intimate apparel, earrings)


Article 16 – Shipping and Return Logistics

Mabel Boutique utilizes third-party logistics providers (3PLs) in both China and the United States.

Your order may ship from either location, depending on product availability at the time of purchase.

Consequently, returns may need to be sent back to either the USA or China. The precise return address and detailed instructions will be provided upon approval of your return request.

Mabel Boutique  is registered in Hong Kong. All agreements between Mabel Boutique and the consumer are governed by the laws of Hong Kong.

This is subject to mandatory consumer protection laws in the customer’s country or state of residence. These Terms do not limit any statutory rights afforded to you under local law.

When we use the term “Verified Boutique,” it signifies our recognized legitimacy across trusted platforms, including:

  • Meta (Facebook / Instagram Shop)

  • Shopify, Pinterest, and Google

We are further supported by positive customer reviews on platforms such as Trustpilot and Loox, reflecting our dedication to reliability and customer satisfaction.


Article 18 – Legal Disclaimer

Our return and exchange policy is subject to change without prior notice.
Mabel Boutique reserves the right to make the final decision on the eligibility of any return or exchange request.

While we strive for product accuracy:

  • Colors and shapes may show minor variations due to lighting, screen settings, or manufacturing batches

  • Sizes and dimensions may have slight discrepancies

  • Some items are shipped directly from the manufacturer, which may lead to longer delivery times or unexpected packaging


Article 15 – Amendments to Terms

We may revise these General Terms. Consumers will be informed of any changes at least 30 days before they take effect.
